Sikkim HC Orders Fact-Finding Probe Into Burtuk Law College Infrastructure
GANGTOK, SEPT 23: The Sikkim High Court has ordered a fact-finding inquiry into the infrastructure and facilities at Sikkim Government Law College, Burtuk, following concerns raised over the condition of the institution.

A Division Bench comprising Chief Justice A. Muhamed Mustaque and Justice Bhaskar Raj Pradhan, hearing the suo motu PIL on September 22, said that several issues concerning the college “need to be addressed”, including the structural stability of the building, library facilities, moot court halls, conference hall/auditorium, hostel accommodation, washrooms and toilets, and sports facilities.

The PIL was initiated on the basis of a September 11 representation submitted to the Chief Justice by former students and members of the Representative Council of the college.

During the hearing, three students—5th-year student Tilak Sharma and 4th-year students Bibachana Rai and Shrijan Pradhan—appeared before the Bench and presented photographs of the college building. Taking statements and photographs of the students, the court said the students had “sought to demonstrate the pitiable infrastructure conditions of the Law College.”

After hearing the students and the Additional Advocate General, the Bench said: “Having considered these issues, this Court is of the view that there is a need to appoint a Fact-Finding Committee for an inquiry by the Members of the Bar Associations of Sikkim and for submission of a report before this Court.”

The five-member committee comprises Senior Advocate Karma Thinlay Namgyal as convenor, Senior Advocate Tashi Rapten Barfungpa, Deputy Solicitor General of India Sangita Pradhan, and Advocates Zola Megi and Kazi Sangay Thupden as members.

The committee has been directed to report on the deficiencies identified by the court. Separately, the Bench ordered the Structural Engineer of the Buildings & Housing Department, Government of Sikkim, to inspect the college building immediately and submit a report on its stability before the next hearing.

The court also directed the State government to file a statement detailing the measures it proposes to take to address the issues and “the timeline within which these measures would be undertaken.”

The proceedings come amid a dispute over infrastructure and academic facilities at the college. Students had raised concerns over the condition of the premises, including water seepage in the library, and had sought improvements in academic and student facilities. The Education Department had sought additional time for repair and renovation work, while arrangements were made for classes to continue through online and offline modes.

The State told the High Court that “arrangements have been made to conduct offline and online classes.” The court recorded the statement while directing that the infrastructure issues be examined independently.

The Bench has now “adjourn[ed] this matter to obtain the facts mentioned above by next posting” and posted the case for September 29, 2026.

The court's order places the structural safety of the college building as a separate issue from the broader question of whether the institution has adequate academic and student facilities, with reports from both the structural engineer and the fact-finding committee expected to assist the Bench at the next hearing.
